§ 1
Definitions
The terms used in these Terms and Conditions shall have the following meanings:
GH Development 13 – GH Development 13 spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, at Al. Jerozolimskie 44, 00-024 Warsaw, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw, 11th Commercial Division of the National Court Register, under KRS No. 0001021908, NIP: 5252945837, REGON: 524610069; the personal data provided by the customer in the contact form available on the Website are processed;

Indigital – INDIGITAL WE TRUST Sp. z o.o. with its registered office at ul. Targowa 67/2, Warsaw;

Website/Service – all functionalities relating to electronically provided services made available by GH Development 13 (including subpages);

User – any adult natural person having full legal capacity, a legal person, or an organisational unit without legal personality using the Website. A User may also be a natural person without full legal capacity who has reached the age of 16, subject to obtaining the consent of their legal representative. GH Development 11 shall not be liable for actions and consequences of actions of the persons referred to in the preceding sentence if they acted without the consent of their legal representative;

Materials – any information, works, markings, names, symbols, images, links, comments, avatars, posts, descriptions, captions, regardless of their form, nature, and method of recording or presentation, submitted, disclosed, published, or made available on the Website by the User;

Consumer – a natural person entering into a legal transaction with GH Development 13 that is not directly related to their business or professional activity.
§ 2
General Provisions

These Terms and Conditions set out the rules for using the Website.

The entity providing electronic services within the Website is GH Development 13, while the entity administering the Website on behalf of GH Development 13 is Indigital.

Use of the Website is based on these Terms and Conditions. Where a given service is provided based on specific regulations (separate terms and conditions), prior to the first provision of such a service on the Website the User will be requested to read those terms and conditions and provide separate consent to their content.

Before using the Website, the User is obliged to read these Terms and Conditions.

The Website, including the services offered within it, is intended for natural persons with full legal capacity, legal persons, or organisational units without legal personality, with the reservation that the User may also be a natural person without full legal capacity who has reached the age of 16, subject to obtaining the consent of their legal representative. Acceptance of the Website Terms and Conditions by the User constitutes confirmation that the User meets the requirements referred to in the preceding sentence.

These Terms and Conditions are made available free of charge on the Website in a form that enables the User to obtain, reproduce, and store their content by means of the ICT system used by the User.

In matters not regulated herein, the provision by GH Development 11 of electronic services shall be governed by generally applicable laws, in particular the Act of 18 July 2002 on the provision of electronic services, the Civil Code, the Act of 10 May 2018 on the protection of personal data, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
§ 3
Scope and Rules of Service Provision on the Website

Provision of services to the User on the Website is free of charge.

Within the Website, GH Development 13 enables, in particular:
a) browsing, downloading, playing and reading information and materials (including, among others, photographs, texts, graphics, data, audio-video materials, etc.) made available within the Website;
b) using contact forms enabling Users to obtain answers to questions concerning the offer presented on the Website, and to give consents for the processing of personal data and receiving commercial information. -
An agreement for the provision of electronic services:
a) for the services referred to in section 3.2(a) – is concluded each time upon acceptance of these Terms and Conditions and is terminated upon the User leaving all Website pages;
b) for the services referred to in section 3.2(b) – is concluded each time upon using the contact form and is terminated upon providing answers to the User’s questions submitted via the contact form. -
A Consumer may withdraw from the agreement within 14 days from the date of its conclusion without stating reasons, subject to section 5 below. To meet the deadline, it is sufficient to send the statement before the expiry of the above period. The withdrawal statement should be sent to: info@ghdevelopment.pl. GH Development will send confirmation of receipt of the withdrawal information by e-mail to the User’s e-mail address.

The right of withdrawal shall not apply where the User requests the provision of services (delivery of digital content) before the expiry of the withdrawal period.
§ 4
Use of the Website. User’s Obligations

The User is obliged to use the Website and the services offered within it in a manner consistent with the law, these Terms and Conditions, as well as principles of social coexistence and good practice.

The User is obliged to refrain from any actions infringing the law, the rights of GH Development 13, or the property or personal rights of third parties, in particular from using other persons’ data as their own personal data.

It is prohibited for the User to provide via the Website unlawful or offensive content, information that may mislead, as well as content that may cause disruptions or damage to IT systems.

GH Development shall not be liable for the content and security of websites belonging to other entities, links to which are posted on the Website, imported into the Website, or to which automatic redirection occurs.

To the extent permitted by law, GH Development shall also not be liable for:
a) any damage caused to third parties arising from the User’s use of the Website or individual services in a manner contrary to these Terms and Conditions or applicable law;
b) any damage caused to third parties resulting from the User providing untrue, inaccurate, incomplete or misleading data;
c) damage arising in the event of significant errors in the configuration of the User’s receiving device;
d) any damage arising in connection with the User’s use of data and information from the Website for investment, economic, business, etc. purposes. -
Data and information made available on the Website pages are for informational purposes only and are based on sources which GH Development considers reliable and verified.
§ 5
Technical Requirements

Use of the Website and services provided within it requires the following technical conditions:
a) access to a web browser supporting HTML5, CSS3 and JavaScript;
b) Internet access;
c) an e-mail account – if the User wishes to receive information/answers via e-mail or wishes to receive commercial, advertising, or marketing information via e-mail. -
GH Development 13 informs that despite best efforts it cannot ensure accurate colour representation of photographs presented on the Website, as display depends, among others, on monitor settings and resolution.

GH Development 13 makes efforts to ensure that the Website is available using various configurations of software and hardware available on the market. However, GH Development 13 cannot guarantee that every such configuration will allow use of the entire Website or each service. Moreover, use of all or part of the Website or a given service may require special configuration of software or hardware.

GH Development 13 reserves the right to modify the technical manner of implementing the Website functionalities, in accordance with the scope and conditions resulting from its rights and its technical capabilities, without deterioration of quality and without affecting the scope of rights and obligations of GH Development 13 and the User.

In special cases affecting the security or stability of the ICT system, GH Development 13 has the right to temporarily discontinue or limit service provision without prior notice to Users, and to carry out maintenance works aimed at ensuring the security and stability of the ICT system.

GH Development 13 shall not be liable for interruptions in service provision resulting from failures or malfunctions of ICT systems beyond the control of GH Development 13.

Regardless of the above, GH Development 13 has the right to discontinue service provision at any time if such a justified request is submitted by the Internet provider or another authorised entity. GH Development 13 shall not be liable for damage caused by malfunctioning of the transmission system, including equipment failures, delays, and disruptions in information transmission.

§ 7
Copyright and Other Intellectual Property Rights

All rights to the Website are reserved to GH Development 13, and the rights to its textual and graphic elements, photographs and applications are reserved to GH Development 13 or, as applicable, to the entities whose materials are made available on the Website pages. Both the Website and each of its elements are protected under Polish and international law, in particular the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws No. 24, item 83, as amended) and the Act of 16 April 1993 on Combating Unfair Competition (Journal of Laws No. 47, item 211).

The User is entitled to use the content posted by GH Development 13 on the Website solely for personal use. In particular, without written authorisation granted by GH Development 13 it is not permitted to distribute, transmit, modify, post on other websites, link, or use the Website in whole or in part for commercial or public purposes. It is also prohibited to remove information on copyright and other intellectual property rights, such as trademark rights.

Any use of works or databases made available on the Website pages other than as specified in section 7.2 of these Terms and Conditions without the prior express written consent of GH Development 13 is prohibited, and infringement of GH Development 13’s rights (or the rights of the entities whose works or databases are made available on the Website pages) to protected works and databases will result in liability under civil and criminal law.
§ 8
Complaints

Users have the right to submit complaints regarding use of the Website and individual services provided within the Website. Complaints shall be submitted by the User by sending relevant information:
a) by post to: Al. Jerozolimskie 44, 00-024 Warsaw -
A complaint submission should include at least:
a) identification of the User submitting the complaint (first name, last name, residential address and e-mail address – if the User has one);
b) description of the issue constituting the reason for the complaint;
c) the date and time the issue occurred. -
If the complaint contains deficiencies in relation to the requirements set out in section 8.2 above, GH Development 13 will request the User to supplement them. If deficiencies are not remedied or it is not possible to contact the complainant due to missing contact details, the complaint will be left without consideration, of which GH Development 13 shall promptly notify the User; this does not prejudice the User’s right to pursue claims under generally applicable law.

GH Development 13 shall respond to the User’s complaint regarding the Website within 30 days from the date of receipt. GH Development 13 will provide the response on paper or another durable medium, unless the User indicates that they wish to receive the response by e-mail.

If GH Development 13 does not respond to the Consumer’s complaint within the period referred to in section 4 above, it shall be deemed that GH Development 13 has accepted the complaint.
§ 9
Final Provisions

GH Development 13 has the right to amend these Terms and Conditions to the extent permitted by applicable law, in particular:
a) in the event of technical or functional changes to the Website or the addition of new functionalities;
b) in the event of expanding the scope of services offered by the Website or changes to the services provided;
c) in the event of changes in the law. -
A User who does not accept amendments to the Terms and Conditions or other service terms may terminate the agreement. Continued use of the Website after amendments to the Terms and Conditions or other service terms have been introduced constitutes acceptance thereof.

Amendments to the Website Terms and Conditions will be published as a consolidated version of the Terms and Conditions on the Website and communicated on the Website’s home page 14 days in advance in an appropriate manner enabling analysis of the changes.

Polish law shall apply to all legal relationships arising from these Terms and Conditions. Any disputes shall be resolved by Polish common courts.

In the case of Users who are not Consumers, any disputes with GH Development 13 arising from or related to its operation shall be resolved by the competent court.

Any doubts regarding the content of these Terms and Conditions should be resolved in a manner ensuring their compliance with mandatory provisions of law.
